David Sarver Found Guilty of Two Counts of Criminal Sexual Penetration and Kidnapping 

Albuquerque, NM – Today, a jury found David Sarver guilty of two counts of Criminal Sexual Penetration of a Child Under 13, and First Degree Kidnapping. The trial lasted six days and the jury deliberated for eight hours before serving a guilty conviction.

A criminal complaint was filed in March of 2021 which stated that the defendant had been grooming his young neighbor for several years. The sexual advances towards the victim, who was a minor, became so aggressive that the defendant eventually  tased the victim and held him at gunpoint while raping him. 

The jury confirmed that an aggravated circumstance occurred on both of the Criminal Sexual Penetration charges which means Sarver faces an additional 12 years added to his sentence along with the other three charges he was convicted of today. Sarver is facing up to a total of 66 years in prison.  

“There is no room in society for adults who take advantage of children,” said Bernalillo County District Attorney Raúl Torrez.  “I am proud of the victim and my team for having the courage to go to trial and relive this horrific time in the victim’s life. As my team stated in closing arguments ‘if you believe the victim, you will convict the defendant.’ Today the jury believed the victim and justice was served to this predator. We look forward to sentencing Mr. Sarver in the near future.”
